Limited Liability and Indemnity

Limited liability

To the fullest extent permitted by law, Caruso Consulting Co Ltd is not liable to you or to anyone claiming through you for any indirect, consequential, special, incidental, punitive or exemplary damages or losses arising from your use of, or inability to use, a product, including interruptions or delays, whatever the type of claim. To the fullest extent permitted by law, our maximum aggregate liability does not exceed the amount you paid for the goods the liability relates to.

Where applicable law does not allow the limitation or exclusion of liability for incidental or consequential damages, the limitations above may not apply to you.

Except in the case of our wilful misconduct or fraud, and to the extent permitted by law, you are responsible for any damage to you, your property or a third party arising from the use of a product other than as described on its page.

We are not responsible for delays caused by carriers or by events outside our control, but we will tell you if your order is affected and refund you if we cannot deliver it.

Indemnity

You agree to indemnify Caruso Consulting Co Ltd, its representatives and distributors against claims, including reasonable legal fees, arising from your misuse of a product or your breach of these terms.

Products are not directed at or intended for use in any jurisdiction where their distribution or use would be contrary to law.

Your rights

Nothing in these terms excludes, restricts or modifies a mandatory legal protection you have in the Philippines that cannot lawfully be excluded.
